Eldoret Magistrate Seeks Divorce from Kakamega lawyer

An Eldoret Magistrate and a Kakamega lawyer are headed for what promises to be a bitter divorce. The lawyer denies having married the magistrate, calling their 7-year marriage a ‘friendship’ and seeking a DNA test to establish the paternity of their son. The magistrate, on the other hand, is seeking a divorce on the grounds of desertion, cruelty, and denial of conjugal rights.

Eldoret Magistrate Diana Milimu has filed with the Kapsabet Senior Resident Magistrate Boniface Wachira, seeking to divorce Edwin Sifuna who is an advocate.

Edwin Sifuna is a lawyer based in Kakamega. Milimu wants to divorce Sifuna and receive maintenance for their child.

Lawyer and Magistrate headed for Painful Divorce

Sifuna, on the other hand, has objected to both requests, arguing that they were not married and that the child might not be his. Sifuna claims that he and Diana Milimu’s relationship was one of ‘friendship.’ He says that he was only one among many of Ms. Milimu’s ‘friends.’

The lawyer also wants the case to be heard in Kakamega where he lives and where they lived as a couple.

Milimu had been ordered to pay Sh42,950 to Sifuna after another case was dismissed. Sifuna is demanding a DNA test.

Milimu wants their marriage of seven-years dissolved. She is filing for divorce on grounds of desertion, cruelty, and denial of conjugal rights. She says that the lawyer sent elders to her home who paid Sh 50,000 and five cattle for her as bride price, but Sifuna says he was not present at the said marriage negotiations and has not signed any documents.

The two will appear before SRM Wachira on April 15th and to determine the matters of divorce and child maintenance.
